Terms of Service
Welcome to Applauncher. These Terms of Service (“Terms”) are a legally binding agreement between you and Applauncher Pty Ltd (“Applauncher Pty Ltd,” “we,” “our,” or “us”). By accessing or using Applauncher, our websites, APIs, and related services (collectively, the “Service”), you agree to be bound by these Terms.
1. Who we are
Applauncher Pty Ltd provides tools that let you describe an idea and generate apps, sites, and related artifacts. You can connect third‑party services (e.g., authentication, payments, analytics) and publish your projects to our hosting or your own domain.
2. Eligibility & accounts
- You must be at least 13 years old (or the age of digital consent in your region).
- You’re responsible for activity under your account and for safeguarding credentials.
- If you use the Service on behalf of an organization, you have authority to bind it.
3. Your content & projects
You retain all rights to content you upload or create (“User Content”). You grant Applauncher Pty Ltd a non‑exclusive, worldwide, royalty‑free license to host, process, transmit, and display User Content solely to provide and improve the Service. You’re responsible for your content and for complying with applicable laws when processing personal data through published projects.
4. Generated output & AI tools
- AI output may be inaccurate or incomplete; review and test before use.
- Except where third‑party model/data terms say otherwise, you own your AI output.
- Don’t use the Service to create unlawful, harmful, or infringing materials.
5. Acceptable use
- No illegal/harmful activity; no harassment or exploitation of minors; no violence.
- No IP or privacy infringement; no malware, spam, or unauthorized data collection.
- No attempts to bypass technical limitations, rate limits, or security controls.
6. Subscriptions, fees & taxes
- Certain features may require subscriptions or usage‑based fees; taxes may apply.
- Payments are handled by our processor; you authorize recurring/usage charges.
- Except where required by law, fees are non‑refundable.
7. Third‑party services
Projects may integrate third‑party services (e.g., domain registrars, auth providers, analytics, payment processors). Applauncher Pty Ltd isn’t responsible for third‑party services; their terms govern your use.
8. Publishing & domains
When you publish, you’re responsible for your site/app and for complying with applicable laws (e.g., consumer law, privacy, e‑commerce, accessibility). You must maintain required legal pages (e.g., privacy policy, terms, disclosures) on your published sites.
9. Intellectual property
The Service (software, documentation, and branding) is owned by Applauncher Pty Ltd and its licensors. Except for the limited rights granted in these Terms, we reserve all rights.
10. Confidentiality
We won’t disclose your non‑public content except to provide the Service, comply with the law, or with your permission. You agree not to disclose our non‑public information without consent.
11. Privacy
Your use of the Service is also subject to our Privacy Policy.
12. Warranties & disclaimers
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We don’t guarantee uninterrupted or error‑free operation or that AI output will be accurate or fit your purpose.
13. Limitation of liability
To the maximum extent permitted by law, Applauncher Pty Ltd won’t be liable for indirect, incidental, special, consequential, or punitive damages; or any loss of profits, revenues, data, or goodwill. Our total liability for any claim won’t exceed the amounts you paid for the Service in the 12 months prior to the event giving rise to the claim.
14. Indemnification
You will defend and indemnify Applauncher Pty Ltd against claims, damages, and costs arising from your User Content, your use of the Service, or your violation of these Terms.
15. Termination
You may stop using the Service at any time. We may suspend or terminate the Service or your access if you breach these Terms or cause risk or harm. Sections intended to survive (e.g., IP, limitations, indemnity) continue after termination.
16. Governing law & jurisdiction
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict‑of‑laws rules. Courts located in New South Wales, Australia have exclusive jurisdiction.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we’ll post the updated Terms and update the effective date. Continued use after changes become effective means you accept them.
